I spent about 7 and a half months last year in Spain (August 23, 2020 to April 2, 2021) playing professional basketball. I was traded to a different team about halfway through those months. In both of my contracts for the clubs I played for, it was the club’s responsibility to take care of my work visa while in Spain. I never received the visa from either club, even though it was stated in the contract. On my way back to the States, I flew from Spain to Germany. While going through customs in Germany, I handed the guy my passport, which did not have the visa stamp on it and asked for a residence card, which I was never given. He then asked me many questions about why I didn’t have a visa when I was there for longer than allotted time. I told him I was there because I was playing professional basketball in Spain and that I never received the visa that was in my contract. I proceeded to show him the documentation of my contract to explain why I was there so long and that I had never received my visa from either club. He looked over it and then let me pass through. I am concerned because I am supposed to go on a foreign tour for ten days this summer of 2022 to Italy and Greece. I obviously overstayed my allotted time in Europe without a visit and, though I was not fined or anything leaving the area, will I face any fines or anything when I return? I’ve tried to research and have seen the situation be handled differently. (Granted, most of the things I read had to do with people who overstayed without good reason.) Is there a way to see if I am flagged in the system or if I will face any sort of issues when I go back on this trip? Is this a situation your firm could advise her/us on?
